Please read these Terms and Conditions ("Terms") carefully before using the website atelier-noir.com (the "Site") operated by ATELIER NOIR ("we," "our," or "us").

By accessing or using the Site and/or placing an order, you agree to be bound by these Terms. If you disagree with any part, you may not use the Site.

2. PRODUCTS & ORDERS

Product Information

We strive for accuracy in product descriptions, images, pricing, and availability. However, we do not warrant that descriptions are error-free, complete, or current. Colors may vary slightly due to screen differences. Leather is a natural material — variations in grain, texture, and shade are inherent characteristics, not defects.

Pricing

All prices are in Indian Rupees (INR) and include applicable taxes. Shipping fees are calculated at checkout. We reserve the right to change prices at any time, but price changes will not affect orders already confirmed.

Order Acceptance

Your order is an offer to purchase. We accept your offer when we send an order confirmation email. We reserve the right to refuse or cancel any order (e.g., pricing errors, suspected fraud, inventory issues). If cancelled, we will refund any amount paid.

Payment

Payment is processed securely via our payment partners (Razorpay/Stripe). We do not store full card details. By placing an order, you authorize us to charge your chosen payment method.

3. SHIPPING & DELIVERY

Domestic (India): Free standard shipping (3–5 business days). Express options available at checkout.
International: Rates and times calculated at checkout. Customs duties, taxes, and fees are the recipient's responsibility and are non-refundable.

Risk of loss transfers to you upon delivery. We are not liable for delays caused by carriers, customs, or force majeure events.

4. RETURNS & EXCHANGES

We accept returns within 14 days of delivery for unworn items with original tags and packaging. See our Returns Policy for full details. Return shipping is free for domestic orders. Sale/final sale items are non-returnable.

5. INTELLECTUAL PROPERTY

All content on the Site (text, images, logos, designs, code) is owned by or licensed to ATELIER NOIR and protected by copyright, trademark, and other IP laws. You may not reproduce, distribute, or create derivative works without written permission.

6. USER CONDUCT

You agree not to:

  • Use the Site for any unlawful purpose
  • Interfere with Site security or functionality
  • Scrape, crawl, or harvest data without permission
  • Transmit viruses or malicious code
  • Impersonate any person or entity

7. DISCLAIMERS

No Warranties

The Site and products are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

Leather Characteristics

Vegetable-tanned lambskin develops a patina over time. Natural marks, grain variation, and color shifts are not defects. We are not responsible for normal wear, fading, or patina development.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, ATELIER NOIR shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or goodwill. Our total liability for any claim shall not exceed the amount you paid for the relevant order.

9. INDEMNIFICATION

You agree to indemnify and hold harmless ATELIER NOIR from any claims, damages, or expenses (including legal fees) arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.

10. GOVERNING LAW & DISPUTES

These Terms are governed by the laws of India. Any disputes will be resolved in the courts of Mumbai, Maharashtra. If you are a consumer in the EU/UK, mandatory consumer protections of your country of residence apply.

11. FORCE MAJEURE

We are not liable for delays or failures due to events beyond our control (natural disasters, pandemics, strikes, government actions, etc.).

12. SEVERABILITY & WAIVER

If any provision is unenforceable, the remainder remains in effect. Failure to enforce a right does not waive it.

13. CHANGES TO TERMS

We may update these Terms. Changes take effect when posted with a new "Last updated" date. Continued use constitutes acceptance.
